1. Scope and Acceptance

These terms govern your use of the website at www.explylabs.com. By using the site you accept them; if you do not accept them, please do not use the site. They cover the website only — they are not the terms on which we carry out development work. Any engagement is governed by a separate written contract signed by both parties, and that contract prevails over anything on this page.

3. What This Website Offers

This website provides:

• Information about our development services.
• Information about our software products, including products still in development.
• A project enquiry form, through which you can ask us to quote for work.
• Waitlist registration for products that are not yet publicly available.

4. The Website Sells Nothing

No payment can be made through this website, and no product or service can be purchased or reserved on it. Nothing here is an offer capable of acceptance.

5. Project Enquiries

Submitting the enquiry form is free and places you under no obligation. It is a request for us to contact you: it is not an offer, an order, or a contract, and it does not oblige us to accept the work. If we go ahead, we will send you a written proposal setting out scope, milestones, timeline and price, and a contract comes into existence only when both parties sign a written agreement. Statements on this website about our process, response times or pricing approach describe how we usually work; they are not contractual commitments.

6. Waitlists and Products in Development

Products described as in development are not finished, not available, and not for sale. Joining a waitlist means we will email you once, when the product is available to try. It does not reserve a place, guarantee access, fix a price, or commit us to any launch date. We may change, delay or discontinue any product in development. You can leave a waitlist at any time using the unsubscribe link or by emailing us. Descriptions of planned releases say what we currently intend to build; they are not promises that any particular feature will exist.

7. Intellectual Property

The content of this website — text, graphics, logos, layout and software — belongs to Exply Labs or its licensors and is protected by copyright and other intellectual property rights. You may read, download and print pages for your own personal or internal business use. You may not reproduce, republish, distribute or create derivative works from this content for any other purpose without our prior written permission. We reserve all rights in this content for the purposes of text and data mining, including under Art. 4(3) of Directive (EU) 2019/790.

8. Availability and Accuracy

We aim to keep the website available, accurate and up to date, but we do not guarantee that it will be uninterrupted, error-free or free of harmful components, and we may change or withdraw any part of it at any time. Information published here is general and provided for information only; it is not advice, and you should not rely on it as the sole basis for a decision. Nothing in this section limits any right you have as a consumer under mandatory provisions of the law of your country of residence.

9. Liability

We are liable for damage caused by our intentional misconduct or gross negligence, and for harm to life, body or health, in each case to the extent provided by law; liability of this kind cannot be and is not excluded. Beyond that, and to the extent permitted by applicable law, we are not liable for indirect or consequential loss arising from your use of this website — in particular lost profit, lost data, or business interruption. If you are a consumer, this section does not affect your statutory rights, and nothing in these terms deprives you of the protection of mandatory provisions of the law of the country where you live.

13. Governing Law and Jurisdiction

These terms are governed by Polish law. If you use this website in the course of your business, the courts of Poland have exclusive jurisdiction over any dispute arising from them. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you are habitually resident, and you may bring proceedings either in the courts of Poland or in the courts of that country; we may bring proceedings against you only in the courts of the country where you live.

14. Changes to These Terms

We may update these terms. The current version is always the one published on this page, with its date. Changes apply to your use of the website from the date they are published; they do not apply retrospectively, and they do not alter any contract already signed between us.
